Retirement Order Drafting for Texas Family Law Attorneys

You handle the divorce. I’ll guide you through the process to help the retirement order get approved.

Dividing pensions, 401(k)s, and military benefit plans requires a completely different set of rules than drafting a standard divorce decree. One missed phrase can cause a rejected submission, force you to reopen a closed file, or leave a former client with uncollected funds years down the road.

At The Law Offices of Leonard Morales P.C., I draft qualified domestic relations orders (QDROs) and military retirement division orders for family law attorneys across Texas. Partnering with me lets you focus on resolving your cases while we handle the technical paperwork required by plan administrators.

Retirement Plans I Can Divide

Different plans require different language. I regularly draft and review orders for a wide variety of Texas and federal plans, including:

  • Military Retired Pay – Orders designed to meet Defense Finance and Accounting Service (DFAS) and Uniformed Services Former Spouses' Protection Act (USFSPA) requirements. I handle complex details like the frozen-benefit rule, High-3 calculations, service dates, and Survivor Benefit Plan (SBP) elections.
  • Federal Benefits – Thrift Savings Plan (TSP) orders and court-approved orders for FERS and CSRS pensions through the Office of Personnel Management (OPM).
  • Texas Public Plans – Teacher Retirement System of Texas (TRS), El Paso Firemen & Policemen's Pension Fund, and local city and county retirement systems.
  • Private ERISA Plans – 401(k), 403(b), profit-sharing, and defined benefit pension plans.
  • Union & Specialized Plans – Railroad Retirement benefits, Teamsters funds, and other multi-employer union plans.

How the Process Works

From initial review to final plan acceptance, we keep the process straightforward for your firm and your client:

  1. Send Us the Decree (or Draft) – Bringing me in before the decree is signed allows me to catch potential issues early and fix problematic retirement language.
  2. Plan Identification & Pre-Approval – I review the plan’s specific guidelines, gather model orders, and request administrator pre-approval whenever available.
  3. Drafting the Order – Once I receive the necessary plan details, drafting usually takes about 7 business days.
  4. Presentation to the Court – I can prepare the final order for your team to present to the judge, or I can appear to present it on your behalf.
  5. Follow-Through to Final Acceptance – I remain the point of contact for the plan administrator, making any necessary revisions until the order is fully qualified.

Why Early Timing Matters

A Texas trial court loses plenary power 30 days after a decree is signed. If an unapproved retirement order hits a snag after that window closes, correcting it often requires filing a new petition, serving the ex-spouse, and scheduling another court hearing.

Involving us during settlement negotiations protects your work and saves your client unnecessary court costs down the line.

Fixing Existing Post-Divorce Orders

If a file landed on your desk that was forgotten, rejected by a plan administrator, or drafted with unenforceable terms, I can help resolve it. I regularly assist attorneys with post-divorce enforcement and clarification orders, even on cases finalized years ago.

Transparent Pricing & Fast Turnarounds

Clear fee structures help you set expectations with your clients right away:

  • Standard Defined Contribution Orders (401k/403b): $900 flat fee
  • Military, Federal, & Defined Benefit Pension Orders: $900 flat fee
  • Turnaround Time: Typically 7 business days after receiving plan information

Fees can be billed directly to the client or paid through your firm. Any fee-sharing arrangements adhere strictly to Texas Disciplinary Rule 1.04.

Why Texas Attorneys Partner with Our Firm

I, attorney Leonard Morales, bring over 20 years of legal experience, including service as a former U.S. Army JAG officer. Having drafted hundreds of retirement division orders, I bring deep knowledge to complex federal and military benefit cases that many general practitioners prefer to avoid. When DFAS or a plan administrator sends back comments, I know what caused the issue and how to resolve it efficiently.
